During an employment relationship, situations relating to an employee’s conduct, performance or ability to perform their role can be complex and time consuming. Identifying and managing these issues effectively can save your organisation time and money and protect it from reputational damage. 

Our comprehensive online workshop series takes an in-depth look at three common conduct and capability issues faced by employers – bullying and harassment, poor performance and medical incapacity. The workshop is designed to ensure you understand the practical application of New Zealand’s employment laws in these situations. This will give you the tools to handle conduct, performance and capability related problems in your business effectively, and to tackle difficult scenarios that may arise.

Who should attend?

HR people and business managers who want to learn how to proactively mitigate the risk of performance and conduct-related problems and employment processes. 

For those who have previously attended our Employment Law Fundamentals series, this workshop provides an opportunity to build on your knowledge. However, attendance at the Fundamentals series is not a prerequisite – this workshop will be a deep-dive into common and complex capability and conduct issues which will be valuable to anyone, whether you are relatively new to managing people or have been doing so for years.

What will attendees get from the workshop?

Your employees are one of your organisation’s biggest assets, yet they do come with risk. By the end of this workshop, you will have the knowledge and ability to manage your organisation’s ‘people-risk’ through understanding both the legal and practical aspects of managing performance and conduct-related issues. You will also learn how to manage your business risks if things go wrong.

What will it cover?

The workshop covers how to address and manage issues relating to an employee’s conduct and capability including bullying and harassment, the performance improvement process and issues of medical incapacity. This includes:

  • Bullying and harassment in the workplace – identifying bullying and harassment, workplace policies and culture, managing allegations including investigations, the disciplinary processes and personal grievances.  
  • Performance management – setting standards, monitoring progress, steps if the standards are not met. 
  • Medical incapacity – understand the issues, considering alternatives and ending the employment relationships.  
  • Tricky issues – intermittent absences, misuse of sick leave, medical retirement.
  • Key legislation – Employment Relations Act 2000, Health and Safety at Work Act 2015, Privacy Act 2020.

The workshops are highly recommended for all New Zealand-based organisations as well as Australian-based organisations with responsibilities that reach across the Tasman.
